File Service Terms & Conditions

These Terms & Conditions ("Agreement") govern access to and use of the FMHQ Tune Portal / Force Maps HQ Dealer System ("the Portal").

By registering, accessing, or using the Portal, you ("Dealer", "User") agree to be bound by this Agreement.

1. Scope of Services

The Portal provides:

ECU tuning files DTC removal services File modification services Credit-based purchasing system Dealer support services

All services are provided digitally unless otherwise stated.

1. Dealer Responsibility

The Dealer is solely responsible for:

Ensuring the vehicle is mechanically sound and suitable for tuning Performing all necessary diagnostics prior to requesting a file Ensuring correct file reading, writing, and installation

Force Maps HQ / FMHQ accepts no responsibility for:

Engine failure Turbo failure Gearbox failure Any mechanical or electrical damage

All files are supplied as-is and used entirely at the Dealer’s own risk.

1. No Refund Policy All sales are final No refunds will be issued under any circumstances once a file has been delivered Credits purchased are non-refundable and non-transferable

This includes:

Unused credits Account closure Switching to another tuning provider

1. Credits & Account Balance Credits must be paid for in advance Credits have no cash refund value Credits may not be exchanged, refunded, or withdrawn

We reserve the right to:

Adjust credit pricing at any time Suspend accounts in cases of suspicious or abusive activity

1. Intellectual Property & File Protection

All files, data, and content supplied remain the exclusive property of Force Maps HQ / FMHQ.

The Dealer is strictly prohibited from:

Sharing files with third parties Allowing other tuners to view, access, or analyze files Reselling or redistributing files Modifying, reverse engineering, or reusing files for any purpose

Any breach will result in:

Immediate account termination Legal action where applicable

1. Non-Circumvention

The Dealer agrees not to:

Use FMHQ files as a base for further tuning by another tuner Attempt to replicate or extract tuning strategies

All work provided remains proprietary.

1. File Requests & Turnaround

Turnaround times are estimates only and not guaranteed Complex files may require additional time No liability is accepted for delays

1. Clone & Unauthorized Tools Policy

Force Maps HQ / FMHQ does not support the use of clone, fake, or unauthorized tools.

By using the Portal, the Dealer confirms that all tools used are:

Genuine Licensed Legally obtained

We reserve the right to:

Immediately suspend or terminate any account suspected of using clone or unauthorized tools Refuse service without prior notice

No refunds will be issued in such cases, and any remaining credits will be forfeited.

1. Disputes & Withholding of Services

We reserve the right to:

Suspend the Dealer account Withhold file delivery Refuse further service

In cases of:

Payment disputes Chargebacks Abuse of the system Breach of these Terms 10. Outstanding Balances & Tool Release

We reserve the right to withhold any tools, services, or access, including but not limited to:

Slave tool releases File access Account functionality

Until:

All outstanding balances are paid in full Any disputes are resolved to our satisfaction 11. Account Termination

We reserve the right to terminate access at any time, including for:

Breach of these Terms File misuse Unauthorized sharing Use of unauthorized tools Disputes or abusive behaviour

Termination does not entitle the Dealer to any refund.

1. Limitation of Liability

To the maximum extent permitted by law:

Force Maps HQ / FMHQ shall not be liable for:

Any damages arising from use of files Loss of business or income Mechanical or electrical failures

All services are used entirely at the Dealer’s own risk.

1. Ownership of Content

All content, including but not limited to:

Tuning files Software Strategies Data structures

Remains the sole intellectual property of Force Maps HQ / FMHQ.

No rights are transferred to the Dealer.

1. Amendments

We reserve the right to update these Terms at any time. Continued use of the Portal constitutes acceptance of any updated Terms.

1. Acceptance of Terms

By using the Portal, the Dealer confirms that they:

Have read and understood these Terms Accept full responsibility for all work performed Agree to comply fully with this Agreement 16. Chargebacks & Payment Disputes

Any form of payment dispute, reversal, or chargeback initiated by the Dealer will be treated as a serious breach of this Agreement.

In such cases, Force Maps HQ / FMHQ reserves the right to:

Immediately suspend or permanently terminate the Dealer’s account Permanently blacklist the Dealer from all current and future services Withhold any remaining credits, files, or services without refund Refuse any future business or re-registration attempts

The Dealer agrees that:

No chargebacks will be initiated once a file has been delivered Any disputes must be handled directly with Force Maps HQ / FMHQ before contacting a payment provider

Initiating a chargeback after delivery of a digital product will result in immediate and permanent blacklisting.
